The CIDE-Bets tax revision discussion is active in Congresso through 2026 and may change the effective tax rate. Advertising restrictions are being debated and may tighten. State-level regulatory overlays are continuing to evolve in some states. The federal framework itself is settled.
What to do now if you intend to apply
SPA-MF processes new applications in 4 to 6 months if the file is clean. Local incorporation, BRL 30M licence fee, BRL 5M minimum capital, BRL 5M guarantee deposit, and the technical and AML integration work. Plus a Brazilian operating team and a marketing budget that can compete in a market where 70 operators are already trading.
How foreign operators should think about their position
Brazil rewards operators with mature LATAM operating experience, robust local marketing capability, and PIX-native CRM economics. It punishes operators that underinvest in Brazilian-localised marketing or treat Brazil as a copy-paste of European operations. Effective tax of around 17% on revenue plus marketing intensity defines the unit economics; the licensing barrier is no longer the rate-limiting factor.
